Children’s rights/Human rights: Obligation & right to act for protection

There exists a clear obligation and right of every parent to protect children from harm, danger and damage. This is established across several international treaties/laws as well as domestic laws.

Some of the most relevant instruments are:

  1. UNITED NATIONS CONVENTION ON THE RIGHTS OF THE CHILD (CRC).

This is the primary international treaty governing children’s rights. It has been ratified by nearly every country in the world. Key articles include:

**Article 3** The best interest of the child must be a primary consideration in all actions concerning children.

**Article 5** States must respect the responsibilities, rights and duties of parents to provide appropriate guidance and direction consistent with the child’s evolving capacities.

**Article 9** A child should not be separated from parents except when necessary for the child’s best interests, such as abuse or neglect.

**Article 18(2)** States shall assist parents in carrying out these responsibilities.

**Article 19** States must protect children from: Physical violence, Mental violence, Injury, Abuse, Neglect, Negligent treatment, Maltreatment, Sexual abuse.

**Article 24** Protection of children’s health.

**Article 27** Parents have the primary responsibility to secure the child’s standard of living.

**Article 34** Protection from sexual exploitation.

**Article 35** Protection from trafficking.

**Article 36** Protection from all other forms of exploitation.

**Article 37** Protection from torture or cruel, inhuman or degrading treatment.

**Article 39** Recovery and rehabilitation of child victims.

CRC general comment No. 13 interprets article 19. It explains that parents have:

  • A duty to protect children from violence
  • A duty to prevent foreseeable harm
  • A duty to supervise according to the child’s age
  • A duty to provide safe care
  • A duty to intervene where risks are known

It also emphasizes that children have a right to protection from **all forms of violence**

**Article 16(3)** The family is the natural and fundamental group unit of society.

**Article 25(2)** Motherhood and childhood are entitled to special care and assistance.

3. INTERNATIONAL COVENANT ON CIVIL AND POLITICAL RIGHTS (ICCPR)

4. INTERNATIONAL COVENANT ON ECONOMIC, SOCIAL AND CULTURAL RIGHTS (ISESCR)

5. CONVENTION ON THE ELIMINATION OF ALL FORMS OF DISCRIMINATION AGAINST WOMEN (CEDAW)

**Article 5(b)** States recognize: The common responsibility of men and women in the upbringing and development of their children, with the interest of the children being the primordial consideration.

This reinforces parental responsibility.

7. COUNCIL OF EUROPE CONVENTION ON THE PROTECTION OF CHILDREN AGAINST SEXUAL EXPLOITATION AND SEXUAL ABUSE

Requires states to:

  • Protect victims

8. COUNCIL OF EUROPE CONVENTION ON PREVENTING AND COMBATING VIOLENCE AGAINST WOMEN AND DOMESTIC VIOLENCE

Recognizes children as victims of domestic violence and requires protection.

The above conventions + additional laws, show a consistent principle:

  1. **Parents have the primary responsibility** for raising and protecting their child
  2. **Children have an independent right** to be protected from violence, abuse, neglect, exploitation and foreseeable harm
  3. **States must support parents** in fulfilling these responsibilities

International and domestic treaties & law give parents the responsibility accompanied by corresponding rights to protect their child.

It is recognized that parents ordinarily have both the authority and the obligation to act to safeguard their child’s welfare – when this parental authority is exercised in the child’s best interests and consistently with the child’s rights under (inter-)national law.

When governments worldwide not only fail to act to uphold children’s rights and issue protection, but they deliberately perpetrate violence unto the safe mother (parent) and child – Then where can a mother still turn to protect her child and herself?

When it is crystal clear and rooted in evidence that governments (police, courts, youth services, foster care), including in Belgium, Australia, Netherlands intentionally traffic a child over international borders from the safe mother to be delivered into known abuse and pedophilia…???
